Accident-Attorney News: Victims File Lawsuit After Car Accident

Wednesday, June 11th, 2014 By

What is your health worth? Imagine you’re recovering from injuries after a car accident with a negligent driver. What price would you put on your pain and suffering?

Unfortunately, too many people struggle through this situation every year. Many face a grueling physical therapy regimen; others discover that they will never recover, and they’ll need assistance to complete everyday tasks, including dressing and eating.

One Ocean City family has been struggling ever since an auto accident two and a half years ago. Now, they are taking matters into their own hands.

In December 2011, Andre James Kaczynski smoked PCP to ease his chronic back pain before getting into his truck and driving down the highway. Naturally, the hallucinogen affected his ability to drive, and he began to speed and swerve dangerously.

When he exited the highway and reached a red light, he never even slowed down. He was driving at 90 mph when he rear-ended a vehicle that was stopped at the light. The results were catastrophic.

Kacynski’s Victims Were a Mother and Her Baby

Annemarie DelRicco was out running errands with her 18-month-old daughter Ava when Kacynski struck her car. The force of the car accident was so great that firefighters needed to tear the car apart to rescue the mother and daughter.

Photos from the scene show DelRicco’s car absolutely destroyed, and police commented that the two were lucky to be alive. Kacynski was rattled but mostly unhurt after the accident. The DelRicco’s weren’t so lucky.

Annemarie DalRicco suffered a broken arm and severe head trauma. Ava, who was in the back seat, took the worst of the force, suffering two broken legs and a traumatic brain injury.

After the accident, Ava underwent four separate brain surgeries and required a feeding tube to eat. Doctors worried that she may never breathe on her own. Luckily, Ava defied their expectations and is now able to both breathe on her own and interact with her parents.

Even so, she is deaf, blind and will never have the ability to care for herself.

If you’ve been injured in an accident with a reckless driver, you may be able to recover compensation for your injuries. An accident attorney in Ocean City can help you file the necessary paperwork and help you seek the money you deserve.

The DelRiccos Recently FIled a Lawsuit Over the Car Accident

Delmarva Now reports that the family filed a lawsuit against Kaczynski, who is currently serving a 10-year prison sentence for driving under the influence. They are asking for $75,000 for pain and suffering, as well as loss of consortium.

A jury trial could start on December 10, but most personal-injury lawsuits settle before trial.
